1. Agreement to these terms
By creating or using an ASIC Assist account, you agree to these Terms of Use and the Privacy Policy. If you do not agree, you must not use the member services. Your acceptance is recorded against your account, together with the date and the version accepted.
You must be at least 18 years old and able to enter a binding agreement. If you use ASIC Assist for a business or organisation, you confirm that you have authority to act for it.
2. Independent service
ASIC Assist is an independent Australian compliance assistance service. It is not the Australian Securities and Investments Commission and is not affiliated with, endorsed by or operated by ASIC or any other regulator.
3. What the service provides
Depending on your membership, ASIC Assist may provide community discussions, Compliance AI responses, a private workspace and Human Assist. Service limits, inclusions and prices are those displayed when you join or purchase.
Basic Human Assist is intended for one straightforward request and includes up to 20 minutes of staff time in each eligible calendar month. Unused requests or time do not carry over. If a matter requires additional work, we will explain the proposed work and price before proceeding. No additional paid work begins unless you agree.
4. General information, not professional advice
Information supplied through Compliance AI, Human Assist, the community or any other part of ASIC Assist is general compliance information and practical assistance. It is not legal, financial, tax or accounting advice and does not create a solicitor and client, accountant and client, financial adviser and client, or other professional adviser relationship.
A response is based on the information available at the time and the facts you provide. It may not identify every issue, exception, document, fee, deadline or change in law or regulatory practice. We do not guarantee that a regulator, court, tribunal, dispute resolution body or other person will accept a response, document or proposed course of action.
5. Your responsibilities
You remain responsible for your business, licence, registrations, decisions, documents, lodgements, fees and deadlines. Before relying on a response, you must consider whether it suits your circumstances, check current official requirements and obtain qualified professional advice where the matter warrants it.
You must provide accurate and complete information, promptly correct material errors and avoid uploading information you are not entitled to use or disclose. Unless we expressly agree in writing to a specific additional service, ASIC Assist does not monitor your obligations, lodge forms, act as your agent or take responsibility for a deadline.
6. Compliance AI
Compliance AI uses automated systems and may use current public sources to form a response. Automated responses can be incomplete, inaccurate or unsuitable for a particular situation. You must not treat an AI response as a substitute for checking official sources or obtaining professional advice. Do not submit highly sensitive information unless it is necessary and you are authorised to do so.
7. Community content
Community questions and replies are contributed by members. They are not approved professional advice and do not necessarily represent ASIC Assist. You are responsible for content you post. You must not post unlawful, misleading, abusive, confidential or infringing material, or personal information without proper authority.
Anonymous posting hides your displayed account name, but it does not remove names or identifying details from the words and documents you upload. You must check and redact documents before sharing them. We may moderate, restrict or remove community content where reasonably necessary.
8. Accounts and acceptable use
You are responsible for activity through your account and for keeping access to your sign in method secure. You must not misuse the service, attempt unauthorised access, interfere with its operation, scrape content at scale, impersonate another person or use the service for unlawful conduct. We may suspend or close access where reasonably necessary to protect users, the service or the law.
9. Memberships and payments
Prices are in Australian dollars unless stated otherwise. Payments are processed by Stripe. Standard membership renews monthly after any stated trial until cancelled. Cancellation stops future renewal but does not ordinarily refund a period already supplied, except where required by law. Founding membership runs for the period stated at purchase. We may change future prices or inclusions on reasonable notice, but will not retrospectively shorten a prepaid fixed term.
10. Intellectual property
ASIC Assist owns or licenses the site, branding, software and original service materials. You retain ownership of content you submit. You give us a limited licence to store, process, display and transmit that content as needed to provide, secure and administer the service. You may use responses supplied to your private workspace for your own internal business and compliance purposes.
11. Availability and changes
We aim to keep ASIC Assist available but do not promise uninterrupted or error free operation. Features may be maintained, improved, restricted or discontinued. We will take reasonable steps to avoid material disruption and to notify members of significant changes where practicable.
12. Consumer rights and limitation of liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
Subject to those non excludable rights, and to the maximum extent permitted by law, ASIC Assist is not liable for loss to the extent it is caused or contributed to by incomplete or inaccurate information you provide, your failure to check current official requirements or deadlines, use of a response outside its stated scope, community content, an unauthorised upload, or a decision by a regulator or other third party. To the extent the law permits, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of data that was not directly caused by our failure to meet an applicable obligation.
Where a guarantee applies to a service supplied mainly for business purposes and the law permits liability to be limited, our liability is limited, at our option, to supplying the service again or paying the reasonable cost of having it supplied again. This limitation does not apply where it would not be fair or reasonable, or where the law otherwise prevents it.
13. Complaints
Please send complaints or concerns to help@asicassist.com.au. We will consider the issue and respond within a reasonable time. Nothing in this process prevents you from exercising any right available under law.
14. Changes to these terms
We may update these terms for legal, security or service changes. If a change is material, we may require you to accept the new version before continuing to use member services. The effective date and version identify the terms that apply.
15. Governing law
These terms are governed by the laws of South Australia and applicable Commonwealth laws. The courts and tribunals of South Australia have non exclusive jurisdiction, subject to any right you have to bring a claim elsewhere.
